Healthcare delivery in the 21st century has become increasingly complex and demanding. Clinical consultations frequently raise scientific, ethical and legal challenges. While scientific issues may be resolved using evidence-based medicine (EBM) approach, the ethical theory is needed to justify decision making in the face of ethical conflict. Medical ethics, law and human rights: a South African perspective provides the conceptual background and analytic skills necessary to assist with the resolution of ethical dilemmas encountered in the South African healthcare environment. Medical ethics, law and human rights: a South African perspective uses case studies to help the healthcare team to identify and analyse ethical, moral and value concepts, and to apply these to scenarios that they may encounter on a daily basis. Part 1 explores theories and principles of ethics (including African philosophy), introduces medical law, discusses health and human rights, and also makes the transition from theory to practice. Part 2 looks at specific topics in healthcare that raise challenges from an ethics perspective - HIV/AIDS, use of social media, euthanasia, human reproduction, genetics and genomics. In view of the increasing emphasis on ethical considerations in healthcare from the Health Professions Council of South Africa (HPCSA), coupled with the rising incidence of litigation in healthcare, Medical ethics, law and human rights: a South African perspective is essential reading for health science, law and philosophy students as well as practising healthcare professionals.

Education in South Africa currently poses enormous challenges to everyone involved, including the State, parents, school governing bodies, principals and educators. To ensure the creation of an effective education system, a sound employment relationship between the State and educators, and thorough knowledge and understanding of the correct application and implementation of education labour law, is vital. Labour relations in education: a South African perspective focuses on those issues that influence the daily life of the education manager, the school governing body and the individual educator. This title attempts to analyse, describe and clarify the most important legal principles regulating employment relations in the education sector - the Constitution includes, in the Bill of Rights, a number of provisions that have a direct bearing on education in general and fair labour practice in education in particular. This new edition discusses recent court cases and amended legislative provisions and expands on some issues that did not receive detailed attention in the first edition. Labour relations in education is aimed at the principal as an education manager in public schools in South Africa and students of the subject of Education Law. Deputy principals and heads of departments, and in fact any teacher who is interested in the management of education, will also benefit from it.

The advent of democracy in South Africa in 1994 demanded a fundamental reassessment and transformation of the nature and style of policing. The Constituion of the Republic of South Africa prescribes the establishment of national poice service, which is required to be representative, legitimate, impartial, transparent and accountable. In terms of the Constitution, the police service must uphold and protect the fundamental rights of all people, and execute its mission in consultation and co-operation with community and government, and in accordance with their needs. Smart policing was written within this context, and serves as a guideline for law-enforcement officials in South Africa on how to provide the services that they are expected to deliver. It inculdes chapters on: Policies guiding the police and policing; legal aspects of policing; the National Prosecuting Authority and the investigator's role in the prosecution process; police-community relations; crime prevention and partnership policing; effective communication skills for interviweing; conflict transformation as an operational imperative; police administration at a police station; crime intelligence in proactive policing; policing intimate violence; victim empowerrment; performance measurement for policing; partnerships between business and the SAPS.

Numerous opportunities have come and gone over the past 20 years of democracy in South Africa for the State to engage with Civil Society and bring development closer to its intended beneficiaries. Civil Society, through its advocacy initiatives, has secured for itself a greater voice and choice in development, and every role player therein should continuously endeavour to make a difference by participating actively and meaningfully in development. Authentic, sustainable grassroots transformation and development, however, is not possible without public participation, social learning, self-reliance and empowerment. Development, the State and Civil Society in South Africa addresses the practical reality of the development consultant, government and public sector change agent, politician and policymaker. Departing from a humanist and people-centred perspective, it captures the fundamentals upon which most development theory, policy, programmes/projects and practices are based, namely cooperation, participatory planning and public participation. The book follows a holistic, multidisciplinary approach to assessing development management principles and strategies. Important challenges in development management and related practice and policy interventions are also functionally integrated. Contents include the following: Development theories, management and the democratic developmental State; Promoting people-centred development and good governance; The role of developmental non-governmental organisations; The private sector and social responsibility; The role of trade unions and international development agencies; Micro-level development and public participation; Integrated Development Planning (IDP); Social development research; Chapter review questions test knowledge and understanding of issues discussed and encourage critical examination from different perspectives. The final chapter provides guidelines for writing scientific documents and using basic social research methodology - essential skills for all researchers and practitioners in development management.

The labour law applicable to the education environment is comprehensive and covers a vast variety of aspects that everyone within that environment will encounter at one time or another. In the past, most employees in education may have had a vague understanding of particular laws and regulations regarding conditions of employment, but now it is essential to have a basic understanding of all relevant laws and regulations that apply. Teachers, especially, could find themselves in a proverbial minefield if they do not ensure that they have a working knowledge of education law. This is evidenced by the numerous lawsuits, disputes, mediations, disciplinary hearings and often unpleasant implications for individuals (and their families) that arise from charges against offenders in all sectors of education. Legislative changes resulting from altered circumstances in education have led to the need to be constantly aware of the implications and applications of such changes. This urgent need applies not only to principals but to everyone involved in education. On the one hand, the responsibility for correct application and implementation of education legislation lies with the governing body and the head of an institution, but on the other hand, it affects the people who work there. The authors of this book have a keen understanding of this vital need and address it most effectively from their own invaluable experience that stems from practical involvement and thorough research in the field of education. A sound working knowledge of all the aspects that are addressed in this book undoubtedly improves the quality of teaching and learning in the classroom - a critical goal that needs to be pursued. It also creates a safer environment in which everyone can operate. I am personally very grateful for the contribution that this handy guide makes to the ultimate quality of education in South Africa.

What is the point of introducing and executing a policy, programme or project in the lifecycle of an organisation if no forethought has been given to how the success, failure or progressof the exercise will be periodically examined? Both private and public sector organisations need to be responsive to the expectations of their internal and external stakeholders to demonstrate that their performance not only yields the desired results in terms of the 'bottom line' but also that those results have integrity, i.e. what was planned is reflected in their processes and in what was eventually achieved. Monitoring and evaluation of policies, programmes and projects examines the key concepts and practices involved in performance tracking and evaluation. Monitoring and evaluation of policies, programmes and projects has drawn from the diverse experiences and expertise of the authors as well as from practical insights gained from practitioners and teaching students at various training courses, nationally and internationally. The balance between theory and practice makes it easy to understand and apply in the workplace, for the achievement of improved results. In this second edition, chapters have been expanded and re-focused to address emerging trends, and new chapters have been added to address institutionalising monitoring and evaluation to make it more participatory. Monitoring and evaluation of policies, programmes and projects remains both a conceptual text and an academic resource for university students, particularly those in management and public administration, as well as a reference work for practitioners and decision-makers in public and private sector organisations.

Essentially, good governance is the primary mission of the public sector. Effective policy management is a crucial component of good governance if the desired improvements in society are to be achieved. A thorough understanding of the nature, content, processes and outcomes of public policy is not only imperative for continually improving public sector governance but also vital for establishing good public management on a daily basis. The fourth edition of Improving public policy for good governance has been updated and revised substantially. It focuses on integrating the functionally specialised agencies of government, business, labour and civil society into a holistic and efficient policy network. This is necessary in an attempt to deal with the complexities of transformational leadership while addressing optimal development and public services delivery in society, amidst an ever-advancing digital era that is under increasing resource constraints. This book bridges the theory and practice of public policy by linking them in a user-friendly manner. It explains what public policy is and should be, why and how it is created, and how public policy content, processes, outputs and outcomes can be improved to promote optimal good governance. Furthermore, it shows how to achieve sustainable development goals in the information society of the 21st century, particularly in complex developing countries. This edition also contains a new chapter on competing values and the ethics of public policy. Among other issues, it addresses the intractable problems of corruption and nepotism that are endemic to any policy system. Each chapter also includes references to the latest published South African and international resources on various aspects of public policy. Improving public policy for good governance is essential reading material for all students, researchers and practitioners in the field of public policy who require knowledge, insight and/or practical skills in this important field. All contributors are experienced public-policy educators, practitioners and evaluators. Fanie Cloete is Emeritus Professor of Policy Analysis in the Department of Public Management and Governance at the University of Johannesburg, as well as in the School of Public Leadership at Stellenbosch University. He is also a legacy chair of the SA Monitoring and Evaluation Association. Christo de Coning is Professor Extraordinaire in the School for Public Leadership at Stellenbosch University, as well as the Founding Board Member of the Foundation for Sport, Development and Peace, and the Managing Director of the Institute for Sport and Development. Henry Wissink is Professor of Public Governance at the University of KwaZulu-Natal. He is also the former Dean and Head of the School of Management, IT and Governance at UKZN and former Professor and Dean of the Faculty of Commerce and Governmental Studies at the former PE Technikon, which became the Nelson Mandela Metropolitan Universit

Law as a profession was not Dikgang Moseneke's first choice. As a small boy he told his aunt that he wanted to be a traffic officer, but life had other plans for him. At the young age of 15, he was imprisoned for participating in anti-apartheid activities. During his ten years of incarceration, he completed his schooling by correspondence and earned two university degrees. Afterwards he studied law at the University of South Africa.
Practising law during apartheid South Africa brought with it unique challenges, especially to professionals of colour, within a fraught political climate. After some years in general legal practice and at the Bar, and a brief segue into business, Moseneke was persuaded that he would best serve the country's young democracy by taking judicial office. All Rise covers his years on the bench, with particular focus on his 15-year term as a judge at South Africa's apex court, the Constitutional Court, including as the deputy chief justice. As a member of the team that drafted the interim Constitution, Moseneke was well placed to become one of the guardians of its final form. His insights into the Constitutional Court's structure, the values it embodies and the cases that were brought to it make for fascinating reading.

All Rise offers a unique, insider's view of how the judicial system operates at its best and how it responds when it is under fire. From the Constitutional Court of Arthur Chaskalson to the Mogoeng Mogoeng era, Moseneke's understated but astute commentary is a reflection on the country's ongoing but not altogether comfortable journey to a better life for all.
